Service Provisioning
The Customer must be at least eighteen (18) years of age at the
date of application and have the legal capacity to fill in the
Registration Form (whether online or physical) and must ensure
that all information and documents submitted to SDEC for the
purpose of registering for the Service are accurate, true, current
and complete.
Service Installation
The Customer must ensure that the premise have at least two
(2) 13A power outlets available for the usage of equipment to be
installed, site is free from any danger that may cause hazard to
MySRBN installers. If hazard is present, the Customer is
responsible to correct the situation. Should the Customer
refused/fail to correct the situation/condition, SDEC reserve the
right to cancel the installation. Upon successful installation,
SDEC shall provide the Customer with Internet Protocol address
or login name and password, as the case may be.
The Customer must safeguard and maintain the equipment for
the Service after the service installation and will be responsible
for any modification or damage upon any equipment provided
by SDEC due to the Customer’s fault or negligence. The Customer
will have to bear the cost of the equipment according to its
value, as reasonably determined by SDEC.
Fees
Upon connection of the Service to the Customer’s premise, the
Customer shall be liable for and to pay to SDEC the Service fee
within the period stated in the bill and include all charges, fees, costs or
other amount as shown in the bill, notwithstanding that the Customer may dispute
the same for any reason(s) whatsoever.
Billing
The Customer shall be fully responsible to ensure the accuracy
and validity of the billing address, email address and mobile
telephone number as provided in the Registration Form. Online
bill will be made available to the Customer on monthly basis via
Online portal and the Customer agrees to verify the bill made
available online from time to time.
Consent
The Customer shall provide consent to SDEC to use the
Customer’s personal information being used by SDEC in
accordance with the MySRBN Privacy Statement.
Customer’s Information and Privacy Notice
The submission of the Registration Form by the Customer to
subscribe to the Service, the Customer will be providing his
personal data to SDEC. Any personal data provided by the
Customer to SDEC in connection with the Registration Form / the
Service shall be kept confidential and is subject to the Privacy
Notice of SDEC. SDEC shall take all reasonable precautions to
preserve the integrity and prevent any corruption or loss,
damage or destruction of the personal data.
By submitting this Registration Form, the Customer is deemed to
have given consent to MySRBN installers to gain access to the
Customer’s premises with prior notice to place and install the
equipment.
Upon receiving the Customer’s Registration Form, a notification
via SMS or Email confirming the registration will be sent to the
Customer. The Customer will be notified within two (2) days in
the event the registration is successful. An appointment will be
scheduled by the MySRBN installer within two (2) weeks for
installation.
Customer Obligations
The Customer must adhere to the minimum subscription period
of twenty-four (24) months from the date of activation of the
Service or such other minimum period of subscription as may be
determined by SDEC from time to time.
The Customer must comply with the – GENERAL TERMS AND
CONDITIONS of MySRBN, FAIR USAGE POLICY and PRIVACY
POLICY applicable for the Service or value-added services or
sales campaign as may be subscribed by the Customer.
The Customer must not use the Service:
(a) to send spam or unsolicited email messages, and against public interest;
(b) for commercial business purpose or resell the Service;
(c) for any unlawful purpose such as vice or gambling,
(d) infringement of other people\'s intellectual property; and
(e) publishing any defamatory or abusive material;
Suspension
SDEC may, without prior notice, suspend the Service for a period
determined by SDEC in the event that any Fees and/or payment
due hereunder for the Service provided is not settled in full on
due payment date; there is outstanding fee and/or payment due
from the Customer; the Customer failed to comply with the
Terms and Conditions herein including committing any action
that falls within the prohibited use as stated herein; and any
occurrence of scheduled or unscheduled outages which cause an
interruption to the Service, including but not limited to
maintenance of SDEC’s Equipment or systems.
In the event of any suspension of the Service by SDEC, SDEC may
if it deems appropriate at it sole discretion and upon such terms,
as it deems proper reconnect the Service, in which event the
Service shall continue in effect as if the Service had not been
suspended. SDEC shall have the right to impose on the Customer
a reconnection fee at a rate to be notified by SDEC.
Termination
SDEC reserves the right to terminate the Customer’s registration
where the Customer fails to make payment of any of the Fees, charges and/or any sum
due to SDEC as and when it falls due; fails to comply with the terms of this Terms and
Conditions; and/or provides false or incomplete information to SDEC.
SDEC has the right to recover all charges, costs, and interests due
and any other incidental damages that it has incurred.
Amendment, revision and alteration the Service and/or the Terms and Conditions:
SDEC reserves the right from time to time to make any
amendment, revision and alteration as it deemed necessary
and/or required either to its Service or the Terms & Conditions.
The Customer will be notified of such changes via the Customer’s
registered email. Continued usage of the Service by the
Customer will be deemed as acceptance towards the Service
and/or the Terms & Conditions.
Limited Liability:
The Service is provided on “best effort" basis. SDEC makes no
warranty of any kind, either expressed or implied, and expressly
disclaims all implied warranties, including, but not limited to
warranties of accuracy, availability, stability or accessibility of
the Service including access to any online sites or destination or
domain and/or the equipment. SDEC also makes no warranty
that the equipment will be compatible with the Service. The
Customer acknowledges that SDEC does not and cannot in any
practical way supervise, edit or control the content and form of
any information or data accessed by the Customer through the
Service. SDEC shall not be held responsible and hereby disclaim
any and all liabilities whatsoever with regard to any information
or content accessed through the Service.
Tax
The Customer shall bear all Government taxes, service tax, levies
and other costs imposed by law in relation to the provision of the
Service by SDEC. In particular, where Service Tax (“ST”) is
applicable to SDEC as the supplier under this Terms and
Conditions, SDEC is entitled to charge the ST payable to the
Government on the Service and/or any SDEC services or
equipment supplied to the Customer.
